Re: XXXXX -- Petition for Declaratory Judgment --
Tour of Facilities
Dear
XXXXX:
This
letter will confirm the detail of our conversation last week relating to the
Tax Commission's tour of XXXXX's newly expanded manufacturing facilities at
XXXXX, Utah, scheduled for October 30, 1989. Thank you for taking the time to
help arrange this tour We will make every effort to make the tour worthwhile
and informative. If you have any suggestions for deletions or additions to the
schedule outlined below, please give me a call.
The
tour will commence at 9:00 a.m. at XXXXX's office building located at XXXXX in
XXXXX, just off I-15. There are two buildings at that location. Our initial
meeting will be held in a conference room located in the XXXXX building. Please
ask for XXXXX at the front desk.
My
understanding is that at least two commissioners, XXXXX, XXXXX, and you will be
going on the tour. Of course, all of the Commissioners are welcome. If you
think additional personnel from the Auditing Division or any hearing officers
assigned to the case should attend, please let me know.
At
our initial meeting at 9:00 a.m., I will give the commissioners a brief
overview of the legal and factual issues involved, based upon a summary of the
pleadings already on file. My intent will not be to advocate XXXXX's position
at that time, but simply to give the commissioners a legal and factual
framework, as accurately as I can, within which they can evaluate the
information they will receive that day. You will be free to supplement my
overview with your own perspective of the case. I anticipate that this overview
would not take more than 10-15 minutes.
We
will then show the Commission a video tape demonstrating the combustibility of
the fuel pellets manufactured at XXXXX's facilities. This video tape will later
be made part of the record in a formal hearing on XXXXX's petition.
XXXXX,
who is the XXXXX of XXXXX, will then give the commissioners an overview of the
tour. We hope the Commissioners, and anyone from the Commission, will feel free
to ask any questions. Questions about the facilities should be directed to
XXXXX, or XXXXX, who are the most knowledgeable about the operation and who
will be conducting the tour. Any legal questions should be addressed to me.
Unfortunately,
we will not be able to accommodate the Tax Commission's request to video tape
the tour. However, we will introduce photographs at the formal hearing on the
Petition through witnesses who will be subject to questioning.
My
introduction, the video presentation, and the tour overview should not take
more than 30-45 minutes. We will then provide transportation for the commission
to the facilities at XXXXX, which is another 30 minute drive. At XXXXX, we will
receive a guided tour of the facilities. We will break at an appropriate time
for lunch in the XXXXX cafeteria, and finish at approximately 2:00 p.m. or
earlier. We will also provide transportation back to the office building in
XXXXX, where the tour will conclude.
Again,
let me thank you for your efforts in helping to arrange this tour. Please let
me know if you wish to make any changes. Otherwise, we will expect to see you
on XXXXX at 9:00 a.m.
Yours
sincerely,
XXXXX
