STATEMENT OF CASE

This matter came before the Utah State Tax Commission pursuant to Petitioner's appeal of the personal penalty assessment made by the Collection Division.

Petitioner has indicated his desire to withdraw his appeal.

ORDER

Based upon the foregoing, the Tax Commission hereby orders that appeal No. 95-0045 be dismissed.
