STATEMENT OF CASE

This matter comes before the Utah State Tax Commission pursuant to a partial Stipulation and Motion. The parties have moved that the Tax Commission accept their stipulation and partial resolution of appeal No. 88‑2154.

The parties stipulation is attached hereto and incorporated herein by reference.

DECISION AND ORDER

The Tax Commission, after reviewing the stipulation of the parties, approves the same. The issue of taxability of customer connect and reconnect fees is not resolved and shall be scheduled for a hearing before the Tax Commission at the first available date. It is so ordered
