STATEMENT OF CASE
The
above-captioned matter involves an appeal to the Utah State Tax Commission from
the assessment by the Property Tax Division of the Utah State Tax Commission on
the subject property. Petitioner asserted that the subject property should have
a lower taxable value as of the lien date, XXXXX.
Petitioner
and Respondent agreed to the following facts: The value should be reduced to
$$$$$ for tax purposes due to an adjustment for obsolescence, the cost
indicator of value, a modification within the income indicator value,
correction of errors in the stock and debt indicator, and a correction in the
system and allocated Utah value.
XXXXX,
XXXXX, and XXXXX County has standing to object to the assessment of the subject
property pursuant to Utah Code Ann. § 59-2-1013.
ORDER
The
above referenced counties are hereby ordered to show cause within ten (10) days
from the date of this order why the Tax Commission should not accept the
proposed value of $$$$$ as the taxable value of the subject property as of
XXXXX.
If
any county elects to show cause why the Tax Commission should not accept the
proposed value, a written response must be filed with the Tax Commission within
the time limits prescribed. The county must show reasonable cause pursuant to
Utah Code Ann. § 59-2-1013.
Failure
of any county to respond to this order within ten days shall be construed as
acceptance by the county of the proposed valuation.
