STATEMENT OF CASE

This matter came on for hearing on XXXXX before XXXXX, hearing officer for and in behalf of the Utah State Tax Commission.

At the outset, the Hearing Officer was advised by XXXXX, representative of the Utah State Tax Commission Compliance Section that the respondents had filed bankruptcy under Chapter 11 of the United States Bankruptcy Act. The Hearing Officer was further advised that based upon the filing of bankruptcy that the Compliance Section would withdraw their petition for revocation of the sales tax license No. XXXXX.

DECISION AND ORDER

Based upon the representations of the Tax Commission representative it is hereby ordered that the Appeal No. 85-54-0100 is hereby dismissed.
