STATEMENT OF CASE

This matter came before the Utah State Tax Commission for a Formal Hearing on XXXXX. The Utah State Tax Commission was to hear the matter. XXXXX appeared representing the Respondent. XXXXX appeared representing the Petitioners.

Prior to the hearing a settlement proposal was submitted to the Commission for its review and approval. That settlement proposal is as follows:

1. A XXXXX lump sum payment which shall be for all taxes, interest, and penalties for the years prior to XXXXX.

2. The Commission has the right to audit for any over collection of sales tax for the period prior to XXXXX.

ORDER

Based upon the foregoing proposal, the Tax Commission orders an acceptance of the same and an adjustment of the records to the Tax Commission to reflect the payment and receipt of said lump sum settlement in full and complete satisfaction of any and all obligation in tax, penalty and interest prior to XXXXX, for sales tax.
